1. Introduction

1.1 This User Agreement (“Agreement”) governs your use of Bybit’s Auto-Invest service (“Auto-Invest Service”) offered by Bybit Technology Limited (the “Bybit”, “we”, “us” or “our”). If you (the “User”, “you” or  “your”) do not agree to any terms or conditions of this Agreement, you must immediately cease using the Auto-Invest Service.

 

1.2 This Agreement forms a binding agreement between Bybit and you and serves to supplement our Terms of Service found at https://www.bybit.com/app/terms-service/information  (the “Service Agreement”). To the extent of any inconsistency between this Agreement and the Service Agreement, this Agreement shall prevail.

 

1.3 By using the Auto-Invest Service you agree to be legally bound by this Agreement, the Service Agreement and all other terms and conditions and rules relating to Auto-Invest Service that we may publish from time to time.

 

1.4 Our Site and Platform are not intended to provide tax, legal, insurance or investment advice, and nothing on the Site or Platform should be construed as an offer to sell, a solicitation of an offer to buy, or a recommendation for any security or crypto asset by Bybit. You alone are solely responsible for determining whether any investment, security or strategy, or any other product or service, is appropriate or suitable for you based on your investment objectives and personal and financial situation. You should consult an attorney or tax professional regarding your specific legal or tax situation.

 

1.5 Unless otherwise defined in this Agreement, all capitalised terms used in this Agreement shall have the meaning provided in our Service Agreement.

 

2. Activation

2.1 The Auto-Invest Service allows you to schedule one or more future buys of your chosen Digital Assets by authorising Bybit to initiate a recurring order on your behalf (“Auto-Invest Order”).

 

2.2 To activate the Auto-Invest Service, you must complete all required fields for “pay”, “receive”, “amount” and “frequency”; and select “Confirm“ on the Site or App (“Activation”). You may contemporaneously activate or establish several Auto-Invest Orders for different Digital Assets, each referred to as a “Auto-Invest Plan”. A Auto-Invest Plan cannot be modified unless it is wholly terminated and a new Auto-Invest Plan is activated.

 

2.3 This Agreement shall be effective upon Activation of a Auto-Invest Plan and shall remain in full force and effect until you elect to terminate it.

 

2.4 Upon Activation, you authorise Bybit to automatically execute the Auto-Invest Order on your behalf, of your chosen Digital Asset, at the frequency and quantity of Digital Asset set by you; and at the price set out in Paragraph 3 below.

 

3. Price

You agree that each purchase by Bybit on your behalf under the Auto-Invest Order (“Auto-Invest Transaction”) (1) shall be executed at Bybit’s prevailing market price of your chosen Digital Asset and (2) is irreversible.

 

4. Payment

Payment for the Auto-Invest Order shall be deducted from your Account’s available balance. Therefore,  it is your responsibility to maintain an adequate balance or sufficient credit limit in order to avoid any void or cancelled Auto-Invest Order.

 

5. Transaction Fee

You agree to pay the Transaction Fee (as defined in Clause 10 of our Service Agreement) chargeable for each Auto-Invest Transaction.

 

6. General

6.1 We are not obliged to verify any selection made by you for your Auto-Invest Plan. All information and details provided by you in relation to the Auto-Invest Service shall be assumed to be accurate and complete.

 

6.2 You understand and accept the risks that may arise and the related losses you may suffer from using the Auto-Invest Service, including but not limited to:

1. losses caused from your own actions (voluntary or involuntary), decisions or judgments;
2. high price fluctuations of Digital Assets may cause significant losses in a short span of time;
3. technical or technological anomalies may occur and may result in losses in your Digital Assets.

 

6.3 We reserve the right to without prior notice:

1. temporarily or permanently prohibit you from accessing or using the Auto-Invest Service; or
2. suspend or terminate the Auto-Invest Service.

 

You understand and agree that we shall not to the maximum extent permitted by law, be liable to you for any losses caused by such prohibition, suspension or termination.
